AN asylum seeker who settled in Nottingham in the United Kingdom is set to be deported to Malawi, despite claiming to be from Zimbabwe.
Patricia Wadi (38) was held in detention awaiting deportation in December 2008, but this was stopped with just two hours to spare. Supporters say she is due to be deported again.
The previous deportation was halted after help from Alan Simpson, who was then MP for Nottingham South. Supporters of Ms Wadi said deporting her was unlawful because of UK guidelines banning the deportation of Zimbabweans.
But Ms Wadi’s case was complicated because she entered the UK on a Malawi passport in January 2002 but then claimed asylum as a Zimbabwean in 2003.
James Ramowski, an immigration advisor representing Ms Wadi, said: “It appears that from birth she would have been a dual national — both Zimbabwean and Malawian, as she was born in Zimbabwe, and also Malawian, due to being born to Malawian parents.”
But Malawi does not recognise dual nationality for adults and when people turn 21 they have one year to renounce their second nationality. They automatically cease to be Malawian citizens if they do not.
Mr Ramowski added: “Patricia cannot be Malawian as she would have lost this right upon turning 22. She has lived all her life and was born in Zimbabwe.”
When she arrives in Malawi, Mr Ramowski believes, the authorities will then send her to Zimbabwe.Phil Dyer, UK Border Agency East Midlands assistant director, said: “The agency only ever returns those who both we and the independent courts are satisfied do not need our protection and refuse to leave voluntarily.
“We are determined to remove those with no right to be in the UK. More than 3 800 illegal immigrants were removed from the Midlands and East region in the last year.”
Ms Wadi has a Zimbabwean identity card and a birth certificate which she claims prove she was born there.
Other than English, she speaks a Zimbabwean language and is a member of the Nottingham Zimbabwean Community Network.
Mr Ramowski added: “Regardless of nationality, she has never lived in Malawi and has no ties at all to Malawi. Her family continues to live in Zimbabwe.”
Mr Ramowski argues that Ms Wadi’s Malawi passport is false while the UK Border Agency says it is genuine.
The agency confirmed that Ms Wadi was due to be deported but would not confirm the date.
