A 71-year-old woman sold a house twice resulting in the first buyer being prejudiced of R97 700, a Bulawayo magistrate heard yesterday.
Ms Sibongile Msipa was told this at the initial appearance of Getrude Wilson, who is now facing charges of fraud as defined in Section 136 of the Criminal Law (Codification and Reform) Act, Chapter 9:23.
Wilson, of Number 80 Cecil Avenue, Hillside, was not formally charged and was remanded out of custody on US$200 bail to 8 February.
In addition to bail, the court ordered her to report once a week on Mondays to Criminal Investigations Department’s Fraud Section and she should not interfere with evidence.
The court also ordered her to reside at the given address until her case is finalised.
The court heard that on 7 January last year, the complainant, Mr Mandingo Muguthu bought House Number 31191 Entumbane from Wilson who was selling it on behalf of her sister Patricia Mzwanyana.
The agreed price was R97 700 and the complainant paid the full amount in installments.He paid the balance on 25 May and it is the State case that Wilson started making excuses on effecting change of ownership.
The complainant later discovered that Wilson had sold the house to another person while their agreement was still binding.A report was made to the police leading to Wilson’s arrest.
She has since paid back US$4 000.Mr Trust Muduma appeared for the State while Mr Mlamuli Ncube, of Cheda and Partners represented Wilson.
